OWNERSHIP OF INFORMATION; LICENSE TO USE KOESER CAPITALS; REDISTRIBUTION OF DATA

Unless otherwise noted, all rights, titles, and interests in Koeser Capitals, and all information made available through Koeser Capitals or our services, in all languages, formats, and media throughout the world, including, but not limited to, all copyrights and trademarks therein, are the exclusive property of Koeser Capitals, our affiliates or our Data Providers.

All rights, title, and interest in and to any data or other information provided by Interactive Data (IDCO), and all such data/information made available by IDCO through Koeser Capitals or our services, are the property of IDCO, our affiliates or our Data Providers.

Koeser Capitals is dedicated to providing users with a secure and accessible platform for the display of market data, charts, news, and other financial information. Users are strictly prohibited from employing any automated data collection methods (e.g. scripts, APIs, scraping, data mining, robots, etc.), or using technologies to circumvent security mechanisms.

Content on the Koeser Capitals platform is intended solely for display purposes through the website or mobile app interface. Our licensing agreements do not allow downloading, sublicensing, transferring, selling, or distributing Koeser Capitals content without prior written consent.

Violations may lead to user account termination, legal action, and other penalties to protect the interests of Koeser Capitals, its partners, and the user community.

ATTRIBUTION

Koeser Capitals grants all users of koesercapitals.com, and all other available versions of the site, permission to use snapshots of Koeser Capitals charts in analysis, press releases, books, articles, blog posts, and other publications.

Additionally, Koeser Capitals grants permission to use such materials in educational sessions, video broadcasts (e.g., news, analysis, overviews), and other formats under the condition that attribution is clearly visible at all times when charts or products are used.

Attribution must include a reference to Koeser Capitals, for example:

• “Charting platform used for this analysis is provided by Koeser Capitals.”

• “Charts by Koeser Capitals.”

Font size for such attribution must be no smaller than 10pt (13px or 3.4mm).

You can use the “Snapshot” button in the chart toolbar to generate a chart image with attribution included. Any use of Koeser Capitals products outside its platform must retain the original attribution. This applies also to widgets and embeds. Violations may result in permanent bans or legal action.

THIRD PARTY SITES AND ADVERTISERS

Koeser Capitals may include links to third-party websites. Some of these may contain objectionable, unlawful, or inaccurate content. You agree that Koeser Capitals is not responsible for any activity on external websites you access through our platform.

Koeser Capitals does not endorse content or services on third-party sites. Dealings between users and advertisers are strictly between those parties. Koeser Capitals is not liable for any losses or disputes arising from such interactions.

Unauthorized solicitation on Koeser Capitals is strictly prohibited and may result in bans or legal action.

NON-PROFESSIONAL SUBSCRIBER STATUS

As a vendor of official real-time market data from exchanges, Koeser Capitals must determine the status of any data subscriber.

By subscribing as a Non-Professional, you confirm that:

• You use market data solely for personal, non-commercial use.

• You are not registered with the SEC, CFTC, or any regulatory body.

• You do not provide financial or investment advice to others.

• You use your own capital for trading—not funds from clients or employers.

• You are not sharing profits or receiving compensation from third-party trading.

• You do not use Koeser Capitals as a principal, employee, or agent of another entity.

If Koeser Capitals (or its data partners) determines that you qualify as a Professional, you will be liable to pay the difference in subscription cost retroactively. This difference may be charged automatically to your registered payment method.

DERIVED DATA

Displayed prices on Koeser Capitals may be derived using proprietary processes that involve:

• Transforming raw market data using randomized variables,

• Volume-based offsets,

• Engine-blended data.

This derived data is visible only to non-professional clients and cannot be reverse-engineered or accessed in raw form.

ACCESS AND SECURITY

You are responsible for keeping your username, password, and account credentials confidential.

Koeser Capitals is not liable for losses due to:

• Unauthorized access,

• Forgotten logout sessions,

• Compromised passwords.

If you suspect unauthorized activity, notify us immediately and log out after every session.

FEEDBACK TO KOESER CAPITALS

By submitting ideas, content, or proposals (“Contributions”) to Koeser Capitals, you agree that:

• The content is not confidential.

• Koeser Capitals may use or ignore your ideas with no obligation to compensate you.

• Your ideas become the property of Koeser Capitals upon submission.

INDEMNIFICATION

You agree to indemnify and hold Koeser Capitals, its affiliates, officers, agents, employees, and partners harmless from any claims or demands—including attorney fees—arising out of:

TERMINATION

You may delete your Koeser Capitals account at any time via Profile Settings.

Upon deletion:

• Your personal data will be removed (except where required for auditing, fraud prevention, or integrated system data).

• Published contributions (e.g. ideas, charts, comments) may remain on the platform to maintain integrity and transparency.

• Koeser Capitals reserves the right to suspend or terminate your account for violations, inactivity, or legal compliance reasons.

By registering, you consent to receive emails from Koeser Capitals, including:

• Service-related messages,

• Special offers,

• Platform news and updates.

You can unsubscribe via the link in each email.

HOUSE RULES

By creating and using an account, you confirm you’ve read and agree to Koeser Capitals’ House Rules.

THIRD PARTY SOFTWARE

Koeser Capitals may include third-party software. Your use of such tools is governed by their own terms, not those of Koeser Capitals. We provide no warranty for these components.
